What Are the Delaware Sexual Harassment Training Requirements?

The Delaware Discrimination in Employment Act (DDEA) prohibits workplace discrimination and harassment based on various protected characteristics, including race, gender, religion, disability, age, and sexual orientation. The 2018 amendments expanded the Act to specifically address sexual harassment by establishing mandatory training requirements for certain employers.

Training Requirements
  • Employer Size Requirement

    Employers with 50 or more employees in Delaware are required to provide sexual harassment prevention training to their workforce.

  • Interactive Training

    The training must be interactive and cover the prevention of sexual harassment, including the legal aspects and the complaint process.

  • Training for New Employees

    New employees in Delaware must receive this training within 1 year of employment and every two years thereafter.

  • Training for Existing Employees

    Existing employees in Delaware must receive training within one year of the Act's effective date (January 1, 2019) and every two years thereafter.

  • Supervisor Training

    Supervisors in Delaware must receive additional training that covers their specific responsibilities in preventing and addressing sexual harassment.

    The initial training is required within 1 year of becoming a supervisor and every 2 years thereafter.

  • Exemptions

    Delaware employers are not required to provide training to employees who have been employed for less than six months continuously.

    Applicants or independent contractors are not counted toward the 50-employee threshold.

Beginning October 1, 2019, employers, regardless of size, must provide 2 hours of sexual harassment training to all employees. All employees hired on or after October 1, 2019, must receive the training within six months of hire.

Starting January 1, 2020, Senate Bill 1343 requires employers with 5 or more employees, including temporary or seasonal employees, to provide at least 2 hours of sexual harassment training to all supervisory employees and at least one hour of sexual harassment training to all nonsupervisory employees, and once every 2 years thereafter, as specified.

Effective January 1, 2020, SB75 requires all employers with 1 or more employees to provide sexual harassment prevention training to all employees and supervisors within the first calendar week of the employee's employment, and on an annual basis thereafter.
