Also known as the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act 2013, the POSH Act is a legal framework for preventing and addressing sexual harassment in the workplace. The act requires employers to create a policy on sexual harassment, constitute an Internal Complaints Committee (ICC) to receive and investigate complaints of sexual harassment and conduct sensitization and training programs to create awareness about sexual harassment and its impact on individuals and organisations.
The act protects employees, promotes accountability of employers, ensures gender equality, ensures legal compliance, and improves employee morale.
Sexual harassment is considered a violation of the fundamental right to equality of a woman under Articles 14 and 15 of the Constitution of India. It interferes with their right to life and right to live with dignity according to Article 21 of the Constitution. Similarly, under Article 19(1) (g) of the Constitution, sexual harassment is considered a violation of the right to practice or to carry out any occupation, trade or business. which includes a right to a safe environment free from harassment.
In 1993, India ratified the United Nation Convention on Elimination of all Forms of Discrimination against Women. The convention states that “State parties shall take all appropriate measures to eliminate discrimination against women in the field of employment in order to ensure, on a basis of equality of men and women, the same rights.”
According to Section 498A in the IPC, any form of cruelty, whether physical, mental, or emotional, against women is unacceptable. Intentional and unintentional psychological and bodily harm are protected under the section.
